 At time of purchase the customer is responsible for reviewing, and understanding "VIP Anglers," Terms & Conditions. Please contact customer service in the event you need any documentation in a different language.


SHIPPING TERMS

In order to ensure that every customer's order makes it to their desired location "VIP Angler," requires All order's to be shipped directly to the customer. 

RECEIVER

 At time if delivery, the driver is required to verify the customers identity prior to completing the delivery. The receiver must be listed in the shipping documents.

At time of delivery the receiver will need to provide one of the following forms of identification:

• Driver's License

• State ID 

• Passport 

• Government Issued ID

 Once the receivers identity has been confirmed, the receiver will be given an inspection period that shall not exceed 2 hours. 

ADDITIONAL RECEIVERS

In the event the primary customer may not be present at time of delivery, please contact "VIP Angler," immediately and provide the following details for ang additional receiver(s):

• Full Name

• Phone Number

 

CUSTOMER INSPECTION PERIOD

 Once the receivers identity has been confirmed, the receiver will be given an inspection period in order to verify their order is correct, and that the order is not damaged. The inspection period shall not exceed 2 hours. 

ACCEPTING/REFUSING DELIVERY

 Once the receiver has completed their inspection of their order, they will be asked to complete a delivery form and provide multiple signatures. At this time the customer will be able to choose one of the following options:

• Accept Delivery

• Refuse Delivery

 

IN THE EVENT OF A REFUSAL

 The customer will be given the following options:

#1: Receive a refund in the amount of the total of the original order. 


#2: At no additional cost to the customer, have a new undamaged order delivered. (This option may not always be available)

REFUNDS

• All Boat & Kayak transactions are final once the order has been approved, and accepted by the receiver. 

• Boat Parts, and Accessories are fully-refundable for 30 days from the date they received their order. 

• Outboard Motors may be returned within 30 days of receiving their order. All returned Outboard Motors are required to pass inspection prior to the customer receiving any refund. Motors must not be used in the water in order to be eligible for a refund.

 

FINANCED ORDERS

 Typically are not eligible to be returned once the delivery has been accepted by the receiver/customer. It is the customers responsibility to understand their lenders policy in regards to returns. 

 

WARRANTY ISSUES

 Will be handled through whom the warranty is issued through. "VIP Angler," does not provide the warranties. At time of purchase the customer will be provided with all necessary warrant information and documentation prior to completing the transaction. 

NOTICES AND GENERAL PROVISIONS

14.1   Notices.  Any notice given by a party under or in connection with this Agreement shall be in writing and shall be:

(a)      delivered by hand with acknowledgment of receipt or by pre-paid post that provides duly authenticated proof of their content and the date on which the notice was sent to that party’s address stated on the Order (or, if the addressee indicates any other address, shall be sent to such address); or

(b)      sent by email to the address specified in the Order.

14.2   Any notice shall be deemed to have been received:

(a)      if delivered by hand, at the time the notice is left at the proper address and its receipt if acknowledged;

(b)      if sent by pre-paid post, at the time of receipt (or if undelivered for reasons attributable to the addressee, the date of the attempted delivery); or

(c)      if sent by email, at the time of transmission, or, if this time falls outside business hours in the place of receipt, when business hours resume. In this clause 14.2(c), business hours means 9.00am to 5.00pm Monday to Friday on a day that is not a public holiday in the place of receipt.

14.3  Data Protection. We collect, store, use and process your Personal Data in accordance with the Regulation (EU) 2016/ll of April 27, 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC. For further details please refer to our data policy. 

14.4   Third Party Rights.  Pursuant to section 1,257 of the United States Civil Code, this agreement does not and is not intended to give any rights to enforce any of its provisions to any person who is not a party to it.

14.5   Entire Agreement.  This agreement together with any schedule, annex and/or inventory signed by both the Company and the Customer forms the entire agreement between the parties unless otherwise specifically agreed in writing between them.

14.6   Variation.  No amendment or variation of this Agreement shall be binding on the parties unless it is set out in writing, expressed to amend this Agreement and signed by an authorized representative of each party.

14.7   Severance. If any provision or part-provision of this Agreement is or becomes invalid, illegal or unenforceable, it shall be deemed deleted (but that shall not affect the validity and enforceability of the rest of the agreement. 

14.8   Definition of days. Any reference to “days” shall be deemed to be made to “calendar days”. Any periods expressed in days shall start to be counted from the day immediately following that on which the counting starts.

14.9   Language. This document has been drafted in the "English," language and shall prevail over any other version drafted in a different language. Any translation of these terms and conditions has been drafted for the Customer’s benefit, but shall not be used for the purposes of interpreting these terms and conditions.

14.10 Governing Law and Jurisdiction. This Agreement shall be subject to the exclusive jurisdiction of the United State courts and shall be governed and construed in accordance with the State of Arizona, or the state in which the order was delivered.

 

 In the event this document is suspected to be fraudulent, or containing any false information, "VIP Angler," by law will be obligated to contact the proper authorities and will be required by law to provide any information requested  in regards to any fraudulent related activity.
